Online Casino Law in Malaysia

The Internet is abuzz with stories and comments about Malaysia’s recently passed Gaming Law, which makes online gambling very tempting to many persons. This law is applicable to all forms of gambling including online casino gambling. This includes all online casinos operated in Malaysia.

The next major piece of legislation that came into effect is the Internet Content Provider Act 2020 which regulates online content providers in Malaysia. This Act also covers operators of online casinos. It is pertinent to note that there is no legal protection in place for online gamblers in Malaysia from prosecution for gambling online in the online casino sites established in other countries. Online gambling in Malaysia is therefore subjected to very similar legal standards to that of other countries.

In 2020, an amendment was passed to the Law of Associations and Corporations that came into effect in November of that year. This amendment prohibits online gambling organizations from charging gratuities and penalties from players in the form of advance winnings and entry bonuses. It also prohibits online casinos from requiring members to pay membership fees. These amendments were introduced in response to recommendations made by the Malaysian Gaming Commission of the United Kingdom. The amended law states that any organization that operates an online casino in Malaysia has to be licensed by the Secretary of State. A licensed online casino can then only ask members to pay their monthly or annual dues.

However, not all online casinos in Malaysia are members of the law. Since the law does not apply to them, they can freely engage in online gambling without meeting the legal requirements of the government. This is the main reason why there are a lot of online casinos in Malaysia that are not regulated by law. These online casinos are considered to be operated in the name of another person or company without the legal rights to transact gambling online.

Despite the proliferation of these online casinos that skirt the law, the online gambling industry in Malaysia is still flourishing. There are more than 400 online casino sites in the country, and most of them do not resort to the application of the Law of Associations and Corporations. This shows that online gambling in Malaysia is yet to face legal restriction. With the continued support from the government, online casino operators will soon be able to offer more features to attract customers and convince them that online casinos in Malaysia offer a safe and fun gambling experience.
